In accordance with the provisions of the State of New Jersey Statue, I hereby represent to Coastline Marine Service that I am the owner of the vessel, or have been authorized by the owner, to order or to request repairs
I understand that if I have any questions about what services to request, or if I have any questions as to the total cost for any requested service, I will contact CMS for clarification, otherwise I waive my right to any estimate, written or verbal which I am entitled to under the NJ fair watercraft act. Estimated repairs are just estimates and not the exact amount of the ultimate repair.
I hereby authorize the above repair work to be done with necessary material and hereby grant you and/or your employee permission to operate the boat herein described on local waterways or elsewhere for the purpose of testing and/or inspecting.
Coastline Marine Service is not responsible for unavailability of parts or delays in parts shipments beyond our control or damage to boat or articles left in boat in case of fire, theft or any other cause beyond our control.
I authorize the total charges to be billed to my credit card if payment when work is completed. I understand that if the charges are not paid in accordance with the terms of the invoice, I am responsible for all collection and legal fees incurred to collect the debt owed CMS. Late charges of 3% per month will be added to all unpaid balances over 30 days
I understand that all unpaid balances after 5 days will automatically be billed to my credit card that I have provided.
I understand CMS is not responsible for any freeze damage to boats or engines if freezing temperatures have occurred prior to work being performed.
I understand that while my boat is in storage I will keep the boat fully insured with complete marine insurance, including hull coverage and liability/indemnity insurance. I agree to hold CMS harmless for any liability or damage, or lost items while the boat is in storage as a result of theft, fire, wind, flood, storms, snow, vandalism or any other acts of God. No bailee agreement is entered into by storing my boat at CMS.
Release and Waiver of Subrogation. Boatyard and owner will each look to its own insurance for recovery of any loss resulting from fire or other casualty. Boatyard and owner release one another from such claims. Boatyard and owner waive any right of recovery of insured claims by anyone claiming through them, by way of subrogation, or otherwise, including their respective insurers. This release waiver remains effective despite either party’s failure to obtain insurance. If either party fails to obtain insurance, it bears the full risk of its own loss.
Any storage boats that we are not servicing and/or launching for the summer season will be required to leave by June 1, 2027. Any boats stored here after that date will automatically renew their storage contract with CMS at a variable rate for summer storage and be billed accordingly to the credit card I have provided.
I understand CMS is not responsible for underlying boat and/or mechanical issues unrelated to work performed.
I agree to pay all balances owed upon completion of the above services
Jurisdiction- In the event there are any disputes arising out of any repairs, maintenance, storage, or installation of materials on my boat, I agree that the jurisdiction shall be vested in the Superior Court of New Jersey, Law Division at the Ocean County Court House, Toms River NJ and hereby consent to in personam jurisdiction, by means of forwarding to me a Summons and Complaint by certified mail, return receipt requested to my address.
